Автори статті дослідили рівень відповідності стану житлового забезпечення громадян і житлової політики держави основним принципам житлового права, опираючись на правові акти, статистичні джерела та наукову літературу. Проаналізованого стан розробки житлового законодавства держави та науковий дискурс правознавців щодо основних правових принципів житлового забезпечення населення. Наголошено на потребі дотримання правових принципів житлового забезпечення у політиці держави та судочинстві.
Виокремлено шість періодів розвитку житлового сектора України та встановлено характерні особливості кожного з них. Проаналізовано вплив негативних факторів зовнішнього характеру, зокрема російської війни в Україні, та внутрішніх чинників правового, політичного і соціально-економічного характеру. З’ясовано здобутки і недоліки розвитку житлового сектора за роки незалежності, а також сучасний стан житлової політики і рівень задоволення потреб громадян у житлі.
Виявлено невідповідність рівня житлового забезпечення громадян України міжнародним стандартам та декларованому Конституцією праву особи на гідне житло та охарактеризовано причини цього явища, в тому числі і правові. Окреслено деякі напрями і заходи житлової політики держави і територіальних громад, які допоможуть покращити житлове забезпечення громадян відповідно до принципів цивільного і житлового права.
The authors of the article investigated the level of compliance of the state of housing provision for citizens and the state's housing policy with the basic principles of housing law, based on legal acts, statistical sources and scientific literature. The state of development of the state's housing legislation and the scientific discourse of lawyers on the basic legal principles of housing provision for the population were analyzed. The need to comply with the legal principles of housing provision in state policy and judicial proceedings was emphasized.
Six periods of development of the housing sector of Ukraine were distinguished and the characteristic features of each of them were established. The impact of negative external factors, in particular the Russian war in Ukraine, and internal factors of a legal, political and socio-economic nature were analyzed. The achievements and shortcomings of the development of the housing sector over the years of independence were clarified, as well as the current state of housing policy and the level of satisfaction of citizens' housing needs.
The inconsistency of the level of housing provision for citizens of Ukraine with international standards and the right of an individual to decent housing declared by the Constitution was revealed and the reasons for this phenomenon, including legal ones, were characterized. Some directions and measures of the housing policy of the state and territorial communities are outlined, which will help improve the housing provision of citizens in accordance with the principles of civil and housing law.
