Еволюційні етапи розвитку міжнародно-правового співробітництва у сфері захисту авторських прав

Abstract

Стаття присвячена висвітленню еволюційних етапів розвитку міжнародно-правового співробітництва у сфері права інтелектуальної власності, зокрема, у контексті захисту авторських прав. Стаття містить історичний екскурс до перших транскордонних комунікацій держав та розвитку національних систем правової охорони і захисту авторських прав, аналізу правових механізмів, які розроблялися на національному та міждержавному рівнях у минулих сторіччях. Окремої уваги автор приділяє питанню запуску та розвитку інституційних органів правової охорони та захисту авторських прав у Європі та світі, ретроспективному аналізу актів спеціального законодавства, які регулюють авторські права у країнах континентальної Європи, Латино-Американського регіону та США. Наукова робота містить інформацію щодо укладених двосторонніх угод, які регулювали правила поведінки учасників правовідносин, які виникають під час використання об’єктів авторського права. Стаття виокремлює базові конвенційні документи, які були покладені у фундамент міжнародно-правового співробітництва у сфері захисту авторських прав у ХІХ та ХХ століттях. Автор надає загальну характеристику діяльності міжнаціональних органів у контексті розвитку авторського права, зокрема, специфіці роботи Всесвітньої організації інтелектуальної власності (ВОІВ) та приділяє окремої уваги національному досвіду України у побудові міжнародних контактів, запуску нових інституційних органів та механізмів. Стаття містить інформацію про новий національний орган у системі правової охорони та захисту авторських прав в Україні – Український національний офіс інтелектуальної власності та інновацій. Окрім цього, важливою структурною часткою роботу є характеристика Угоди про торговельні аспекти прав інтелектуальної власності. Поміж іншим, автор підкреслює тенденції та визначає перспективи подальшого розвитку правового регулювання в галузі захисту авторських прав на міжнародному рівні.

The article is devoted to highlighting the evolutionary stages of the development of international legal cooperation in the field of intellectual property law, in particular, in the context of copyright protection. The article contains a historical excursion to the first cross-border communications of states and the development of national systems of legal protection and protection of copyrights, an analysis of legal mechanisms that were developed at the national and interstate levels in the past centuries. The author pays special attention to the issue of the launch and development of institutional bodies for legal protection and protection of copyright in Europe and the world, to a retrospective analysis of acts of special legislation that regulate copyright in the countries of continental Europe, the Latin American region and the USA. The scientific work contains information on concluded bilateral agreements, which regulate the rules of conduct of participants in legal relations that arise during the use of copyright objects. The article singles out the basic convention documents that were laid in the foundation of international legal cooperation in the field of copyright protection in the 19th and 20th centuries. The author provides a general description of the activities of international bodies in the context of the development of copyright, in particular, the specifics of the work of the World Intellectual Property Organization (WIPO), and pays special attention to the national experience of Ukraine in building international contacts, launching new institutional bodies and mechanisms. The article contains information about a new national body in the system of legal protection and protection of copyrights in Ukraine – the Ukrainian National Office of Intellectual Property and Innovation. In addition, an important structural part of the work is the characterization of the Agreement on Trade Aspects of Intellectual Property Rights. Among other things, the author emphasizes the trends and determines the prospects for the further development of legal regulation in the field of copyright protection at the international level.
