Сучасний стан прав осіб з інтелектуальними порушеннями в Україні

Abstract

У статті здійснено аналіз національних нормативно-правових документів, що стосуються прав людей з інтелектуальними порушеннями. Визначені основні нормативно-правові акти, які регулюють життєдіяльність цих осіб. Наголошено на важливості забезпечення прав осіб з інтелектуальними порушеннями, зокрема на послуги на рівні громади, самостійне життя з відповідною підтримкою та включення до місцевої спільноти. Зазначено, що дотримання прав таких осіб є необхідною умовою функціонування будь-якого розвинутого демократичного суспільства, а розбудова сучасної правової держави в аспекті захисту та дотримання прав осіб з інтелектуальними порушеннями полягає у розвитку ефективного, чинного українського законодавства та імплементації норм до міжнародних стандартів, зокрема Конвенції ООН про права осіб з інвалідністю.

В статье осуществлен анализ национальных нормативно-правовых документов, которые касаются прав людей инвалидностью вследствие интеллектуальных нарушений. Определены основные нормативно-правовые акты, которые регулируют жизнедеятельность лиц с интеллектуальными нарушениями. Отмечено важность обеспечения прав таких лиц, в частности на услуги на уровне общины, самостоятельную жизнь с соответствующей поддержкой и включение в местное сообщество. Автор указывает, что соблюдение прав людей с интеллектуальными нарушениями есть необходимым условием функционирования любого демократического общества, а развитие современного правового государства в аспекте защиты и соблюдения прав таких лиц заключается в развитии эффективного действующего украинского законодательства и имплементации норм к международным стандартам, в частности Конвенции ООН о правах людей с инвалидностью.

The article focuses on the analysis of domestic legislative acts concerning human rights of persons with intellectual disabilities. Identified are the legislative acts that determine legal regulations as for the specific aspects of everyday statutory support to persons with intellectual disabilities in Ukraine. It was noticed that in addition to the complex of the human rights determined by the Ukrainian legislation for all citizens, persons with intellectual disabilities exercise specific rights connected to their disability status. Among them are the rights to social protection, disability fee and rehabilitation. It should be noted that legislation is an important tool that guarantees the provision of appropriate services to people with intellectual disabilities, including correctional pedagogical support, care, timely treatment and protection of the rights of these persons. It promotes awareness and education for both service providers and people with disabilities. The author stresses on the importance of human rights implementation of persons with intellectual disabilities, in particular, that to community based services, supported living, community inclusion. The article focuses on the major challenges of the contemporary implementation of human rights and provision of support to the target group which are to be overcome. It is mentioned that both implementation of human rights as well as functioning of the care and support system is the obligatory element of the modern developed society, and establishment of the rule of law in the area of the rights of persons with intellectual disabilities should focus on the development of effective valid legislation and implementation of international standards, in particular, those of the UN Convention on the Rights of Persons with Disabilities and the other international documents.
