Внутрішній та міжнародний аспекти процесу легітимації радянської влади в Україні в 1917-1922 рр.

Abstract

У дисертації здійснено комплексний аналіз процесу легітимації радянської влади в Україні у 1917-1922 рр. Визначено основні засади та особливості формування системи радянського права в Україні. З’ясовано правовий статус, структуру, функції органів законодавчої, виконавчої та судової влади, структур державного контролю, виявлено специфіку їх формування та функціонування. Розкрито важелі й механізми партійного впливу на формування та діяльність представницьких, виконавчих, судових і правоохоронних органів влади республіки і визначено їх роль у становленні тоталітарного режиму в Україні. Обґрунтовано висновок, що внутрішня легітимність радянської влади була досягнута завдяки використанню правлячим режимом традиційних і специфічних засобів легітимації влади. Доведено, що зовнішньополітична активність уряду УСРР у 1920 - 1922 рр. сприяла перетворенню Української радянської держави на реально функціонуючий суб’єкт міжнародного права. Науково обґрунтовано і аргументовано, що легітимація радянської влади в Україні набула усіх формальних й неформальних атрибутів, відтак легітимність радянського уряду стала реальністю як усередині УСРР, так і за її межами.

The author of the thesis carries out a comprehensive analysis of formation and performance of Soviet power in Ukraine in 1917-1922 against the background of acknowledgement of its legitimacy both with the country and on the international arena. The author defines the basic principles and characteristics of formation of the Soviet law system in Ukraine, identifies the legal status, structure and functions of legislative, executive and judicial bodies, state control institutions, specifies particular characteristics of their formation and functioning. The mechanisms and instruments of influence of the party on establishment and activities of the representative, executive, judicial and law-enforcement authorities of the republic and their role in formation of the totalitarian regime in Ukraine are examined in the manuscript. The author draws a conclusion that acknowledgement of the Soviet power by the population of the country was achieved due to use of traditional and specific methods of legalization of power by the party in rule. It has been proved that external affairs of the USSR government in 1920-1922 contributed to the transformation of Ukrainian soviet state into the acting subject of the international law. The author also proves the fact that the process of Soviet power legalization in Ukraine had all the formal and informal attributes, thus the legitimacy of the Soviet government became real both within USSR and abroad.
