Глобалізаційні трансформації правової свідомості суспільства: соціально-філософський аспект

Abstract

Дисертація присвячена соціально-філософському дослідженню глобалізаційних трансформацій правової свідомості суспільства. У результаті дослідження уточнено зміст понять «суспільна свідомість», «правова свідомість» у їхньому співвідношенні зі змістом поняття «глобалізація». Здійснена соціально-філософська реконструкція рецепції суспільної правосвідомості в добу Модерну. Виявлено, що модерна правосвідомість орієнтується на особистісну свободу, автономність, цілераціональність, утилітаризм. Вона коригується ринковими відносинами, орієнтується на реалізацію приватних інтересів, умовою яких є свобода, що осягається розумом. Показано, що у процесі переходу від Модерну до Постмодерну, який наклався на глобалізацію, правосвідомість, як на повсякденному, так і на теоретичному рівнях, зазнає суттєвих змін, які виявляються в атомізації, біфуркаційності, епістемологічній невизначеності тощо.

The research clarified the content of the concepts «social consciousness», «legal consciousness» in their relation to the content of the concept «globalization». The social and philosophical reconstruction of reception of social consciousness in Modern epoch is carried out. The research indicated that modern legal consciousness focuses on personal freedom, autonomy, goal-oriented rationality, utilitarianism. It is adjusted by market relations; it is oriented on the implementation of private interests, which condition is freedom, conceived by reason. The thesis shows that in the transition from Modern to Postmodern overlapped on the globalization processes the legal consciousness at both daily and theoretical levels is being greatly changed, what could be seen in its atomization, bifurcation, epistemological uncertainty. Postmodern legal consciousness is a holistic spiritual phenomenon; its fundamental factor is the subject sensuality, and its key means – instrumental reason, generating fragmentary thinking. Being fundamentally anti-hierarchical and anti-apodictic it denies the possibility and the ability to express the absolute truth. The research states that in the postmodern era traditionalist type societies adapt to the global model of the Western civilization. This adaptation is done with the help of incremental social transformations, in that way traditionalist type societies institutionalize the transitivity as a liminal phase turning it into the type of their stationary state.
