Дисертація є комплексним науковим дослідженням системи прав людини та громадянина в контексті захисту прав пацієнта за допомогою державних і громадських правозахисних механізмів. Дисертантом запропонована авторська класифікація прав людини у сфері охорони здоров’я: конституційно визначені права людини та громадянина; загальні та спеціальні права пацієнтів. Проаналізовано застосування способів захисту прав пацієнта: система оскарження, за допомогою якої вирішуються правові конфлікти у сфері охорони здоров’я; звернення до інститутів судочинства; застосування примирювальних процедур; звернення до недержавних організацій та інших інституцій громадянського суспільства. Розглянуто систему дефектів надання медичної допомоги та види юридичної відповідальності медичних працівників як наслідок юридичного конфлікту. Вироблено систему критеріїв ефективності способів захисту прав пацієнта; виділено головні критерії класифікації недержавних організацій із захисту прав пацієнтів та розкрито основні напрями їх діяльності.
Thesis is the complex scientific research of the system of human and citizen rights in the context of patient rights protection with the help of state and public mechanisms. The author proposes the classification of human rights in the sphere of health protection: human and citizen rights established by the Constitution; general and special patient rights. Such methods of patient rights protection: the system of appeal which is used to resolve law conflicts in the sphere of health protection; judicial recourse; use of conciliatory procedures; application to nongovernmental organizations and another public institutions are analyzed. The system of defects of medical care providing and forms of judicial responsibility of medical workers as result of judicial conflict are considered. The system of effectiveness criterions of protection of patient rights methods was worked out; main criterions of classification of nongovernmental organizations specialized on patient rights protection were distinguished and main directions of their functioning were analyzed.
